The Parents’ Cause of Action Under RCW 4.24.010

Under RCW 4.24.010, a parent or legal guardian who has regularly contributed to the support of a minor child may bring a wrongful death claim for the child’s death. The statute creates a single cause of action, but each parent is entitled to recover for their own loss separately.

Recoverable damages in these cases can include:

Medical and hospital expenses incurred before the infant’s death
Funeral and burial expenses, which are typically recovered through a related survival action
Damages for loss of love and companionship
Damages for destruction of the parent-child relationship

The Survival Action

Washington law also recognizes a separate survival action brought on behalf of the deceased infant’s estate for damages the estate itself would have been entitled to. In some infant death cases, both a wrongful death claim and a survival action may be pursued. These are civil claims, separate from any criminal proceedings that might arise from the same events.
